3. General and special rental terms

Article 1: Subject of the Rental and Driver Requirements

The Lessor grants the Renter use of the vehicle described in Table 2 (motorcycle/moped), together with its accompanying equipment (helmet, keys, etc.). The Renter declares that: (a) they are at least 21 years old; (b) they hold a lawful, valid and current driving licence corresponding exactly to the category of the rented vehicle, which they have shown to the Lessor; and (c) the details stated in Table 1 are entirely accurate.

Article 2: Collection and Return of the Vehicle

The vehicle is delivered to the Renter in excellent working order, clean, free from apparent defects and with the fuel level recorded in Table 2. The Renter must inspect the vehicle on collection and, by signing this agreement, is presumed to have received it in perfect condition. The Renter must return the vehicle to the Lessor on the specified date and at the specified time and agreed location, in the condition in which it was received and with exactly the same fuel level. If the vehicle is returned with less fuel, the Renter is charged for the missing fuel plus refuelling costs.

Article 3: Late Return and Penalties

Any delay in returning the vehicle beyond the agreed time, without timely written or telephone notification and the Lessor's approval, obliges the Renter to pay compensation equal to the daily rental charge for each hour of delay, and to cover any actual loss incurred by the company as a result of a subsequent booking being lost.

Article 4: Conditions of Vehicle Use

The Renter must exercise the care of a prudent driver and strictly comply with the Greek Road Traffic Code. The following are expressly prohibited: (a) driving under the influence of alcohol, narcotic substances or medication affecting driving ability; (b) allowing any third party not named in this agreement to drive or use the vehicle; (c) driving on unpaved roads, dirt roads, difficult trails or off-road routes; (d) using the vehicle for racing, displays, dangerous manoeuvres or carrying persons or goods for payment; (e) taking the vehicle outside Greek territory without the Lessor's prior written consent; and (f) displays and dangerous manoeuvres with the vehicle are expressly prohibited.

Article 5: Liability for Damage, Accidents and Insurance Exclusions

In the event of a road accident or property damage, the Renter must immediately inform the Lessor and the police so that the incident can be recorded. Damage caused by proven negligence, misuse or breach of this agreement is borne solely and in full by the Renter. It is expressly agreed that no insurance covers, and the Renter bears in full, damage to tyres, rims or the underside of the vehicle, a burnt-out or damaged clutch, and loss of or damage to keys, helmets and other accompanying equipment.

Article 6: Security Deposit

To secure compliance with this agreement, the Renter pays or authorises a card hold for the security deposit specified in Table 2. This amount is returned to the Renter without interest at the end of the rental, provided that the vehicle is returned on time, without damage and with the appropriate fuel level. The Lessor reserves the right to retain part or all of the security deposit to cover damage, missing fuel or unpaid fines.

Article 7: Traffic Violations and Fines

All administrative fines, tickets, violations of the Greek Road Traffic Code and expenses of any kind assessed by the authorities and relating to the rental period are borne solely by the Renter. The Renter must inform the Lessor and pay the relevant amounts. Otherwise, the Lessor will recover the amount from the Renter together with an additional violation administration charge.

Article 8: GPS Tracking

The Renter is informed and expressly accepts that the rented vehicle may have a GPS tracking device installed. Location data is processed exclusively for security, theft prevention and efficient management of the Lessor's fleet, in accordance with the General Data Protection Regulation (GDPR).

Article 9: Digital Acceptance and Cancellation Policy

Where the booking and acceptance of the terms took place electronically (through the internet/online booking), that digital acceptance and the related payment are treated as full written acceptance of this agreement, having the force of a handwritten signature. Cancellations are governed by the company's official policy: free cancellation up to 7 days before collection, a 50% refund up to 48 hours before collection, and a non-refundable charge for cancellations less than 48 hours before collection or a no-show.

Article 10: Limitation of Liability and Personal Belongings

The Lessor bears no liability for loss of, theft of or damage to personal belongings of the Renter or their passenger placed in the vehicle during the rental. The Lessor is also not liable for interruption or delay of the rental due to force majeure, including severe weather or government restrictions.

Article 11: Theft and Loss

The Renter is solely liable for any loss of the company's motorcycle rented under this agreement, including, without limitation, partial or total theft, misappropriation, failure to return it, or any other cause resulting in the company's temporary or permanent loss of possession or use. Throughout any period in which, beyond the agreed rental duration, the company is deprived of the motorcycle in any manner solely through the Renter's fault, the Renter must pay daily compensation equal to the agreed rental rate until the vehicle is returned. In the event of total loss, the Renter owes full financial compensation for the vehicle and compensation for the company's non-material damage.

Article 12: Jurisdiction and Governing Law

This agreement is governed by Greek law and the relevant provisions of the Greek Civil Code. The courts of Ioannina are expressly designated as having exclusive jurisdiction over any dispute, disagreement or conflict arising from the interpretation or performance of this agreement.
